Nicholas Cavalier should have spent the past six months waxing down his surfboard and hitting the waves.
He should have been earning a little pocket cash at the parking kiosk on Stearns Wharf and talking baseball with his brother. Or maybe designing that T-shirt or surfboard line he always talked about.
Instead the 22-year-old local spent most of that time in a hospital bed, blinded by a senseless act and suffering from a traumatic brain injury, limited mobility and a fierce longing to be out in the surf again.
He just wanted to help out a friend.
June 7, 2008. 2:28 a.m. By the time police arrived at the intersection of Chapala and Ortega streets, medics were already treating the unconscious victim. Eyewitness accounts were sketchy, but officers pieced together a few details:
Nick and his friend stopped by a burrito place after a night on the town. They ordered and stood around, waiting for their food. Across the street, a group of men — gangsters, according to several witnesses— began jawing at them.
Nick’s buddy, admittedly intoxicated, got into a fight with one of the guys. He managed to scramble away after being knocked to the ground and kicked several times. Nick stepped in to break up the brawl.
Things settled for a moment and a girl tried to calm Nick, placing her hands on his shoulders as he sat down. Then a figure approached. A foot shot up and hit Nick in the face.
He fell backward, his head hitting the sidewalk, a pool of blood slowly forming.
Nobody got a good look at the attacker.
An hour and a half later, Paul Cavalier got a phone call from Santa Barbara Cottage Hospital. His son had been in an accident. Twelve surgical staples were necessary to close the lacerations on the back of Nick’s head. Doctors told Paul that his son’s brain was bruised and bleeding.
“At that time, he was still alert,” Paul said. “Then his brain started to swell.”
After more than five hours of emergency brain surgery, the 22-year-old was placed in a medically induced coma as his parents prayed for the swelling to lessen.
Two weeks later, doctors tried to bring him out of the coma and the swelling started again.
“That’s when he almost died,” Paul said. “The doctor said he wasn’t ready to come out of it yet. That was a really hard time.”
Nick made it out of the coma a week later, but his life was shattered. The traumatic injury weakened his right side and interrupted the conversation between his eyes and his brain.
Worse yet, he wasn’t aware of his limitations. His brain told him that he was fine, that he should be out enjoying his young life.
“Nicholas was still in his denial state, wanting to go to work and surf and hang out with his friends,” his mother, Faith Magdalena, said. “He hadn’t closed the door on his past life.”
After a month and a half of recovery from his feeding tube and tracheotomy, Nick was transferred to the Santa Barbara Cottage Rehabilitation Hospital.
He didn’t like being confined to a hospital bed, but he started making progress, Paul said. And with cortical blindness, there was always a chance his sight would return.
“It’s all wait and see,” his father said.
Then hospital officials called his parents into an office. They had evidence a male nurse abused Nick, hitting him on at least one occasion and turning up the television volume to full blast on a Spanish-language channel, Paul said.
In a letter dated Sept. 29, hospital officials described their reaction.
“Upon learning of this incident, the hospital immediately removed the employee from contact with your son and initiated an investigation,” wrote Melody O’Shock, a risk manager at the hospital. “Once inappropriate behavior had been confirmed, we immediately took necessary steps to ensure that this sort of incident would not happen again.”
Hospital officials declined to comment when contacted, citing patient privacy laws.
Following the incident, Nick became defensive and had more trouble with staff at the rehab center, his father said, sinking into flashes of aggression — a common symptom of traumatic brain injuries.
“Clearly his trust had been broken,” Paul said. “…He’s such a kick-back kid. To see him get angry like that, it’s not him.”
Doctors gave Nick sedatives and kept him in an enclosed bed, his father said, posting a security guard at the door.
Concerned about Nick’s treatment at the hospital and feeling pressured, his parents decided to sign him out and take him home. But it quickly became apparent it wasn’t the right move.
“He should never have been allowed to come home until his impulsivity and periodic agitation was brought under control,” his mother said.
Paul was forced to restrain his 6-foot son several times after he became agitated. Then, without his anti-seizure medication, Nick suffered a seizure in his sleep and his parents took him back to the emergency room, where he was eventually readmitted on Nov. 21.
At that point, Paul said hospital officials told him it was their policy to have his son in four-point restraints and heavily sedated due to his aggressive nature.
When he asked for permission to help Nick take a shower or walk him around, Paul said officials refused, calling it a liability.
Three weeks later, after Paul filed a complaint with the State Department of Public Health and Licensing, the hospital removed the restraints. Officials declined to discuss Nick’s specific case, again citing privacy laws, but hospital spokeswoman Maria Zate said it’s hard to pin down the hospital’s policy when it comes to physically restraining a patient.
“It’s difficult,” she said. “It would probably be on a case-by-case basis.”
Once out of restraints, Nick started improving again, his father said.
“Before, he was losing his life,” Paul said. “He was just lying there. When he got up, he was doing better. He started to make positive strides.”
But two days after Christmas, Paul found out Nick had been taken to jail for allegedly hitting a hospital aide.
According to police documents, Nick called officers to the hospital to report medical personnel battering him. When their investigation revealed the claim was unfounded, officers started to leave.
That’s when staff started screaming for help, telling authorities that Nick was hitting a hospital staff member. Officers returned and spotted an aide stepping away from Nick.
When they grabbed his wrists and tried to calm him down, Nick reportedly tensed up and tried to pull away.
When they took him to the ground, he began resisting and was eventually handcuffed. The aide told police that Nick had pushed him several times. He signed a complaint and Nick was booked for battery and resisting arrest.
“It just seems bizarre for a patient who is being treated in a hospital for a traumatic brain injury to be taken to jail,” Paul said.
A friend of the family who works at the jail recognized Nick and placed him in an isolated cell to keep him safe.
For those who know Nick and grew up with him, jail seems to be the last place they’d expect to find the 22-year-old.
Diana Palmer, parking supervisor at the city waterfront, said she never had any complaints about Nick since he started working at the parking kiosk on the wharf in August 2006.
“He liked to surf, so when he’d see those waves, boy it would be tough for him to keep working,” she said. “…He always had a smile. He got along with everybody.”
He frequently talked about his graphic art designs and his plans to put them on surfboards or T-shirts, she said.
“We miss him,” Palmer said. “I just hope he can get through this and hopefully get his life back.”
A lifelong Santa Barbara resident, Nick graduated from Washington Elementary and San Marcos High schools. He was taking business and art classes at City College until a few months before the incident.
At age 13, he started working with the city, first in youth sports as a camp counselor and flag football coach. He eventually took a part-time job at the waterfront.
“He liked being down by the beach,” his father said. “He worked it out so he could work and surf and pay the rent and chase girls at night.”
Justin Drewich grew up with Nick, first running into him in kindergarten and remaining good friends ever since.
“We pretty much did everything together, surfing and hanging out,” Drewich said. “He was super easygoing, super peaceful. I never saw him get into any trouble.”
When he found out Nick wasn’t cooperating with his therapy and becoming agitated, he knew it had to be the brain injury affecting his personality.
“He would never do anything like that before,” Drewich said. “It’s completely the injury.”
He’s convinced Nick just needs a place where he can be comfortable during his rehabilitation, where he doesn’t feel trapped.
Don Devan, a board member at Jodi House, a local nonprofit that offers services for adults with brain injuries, said aggressiveness is a common byproduct of brain trauma.
“Part of what drives the violence is the crazy isolation that comes with a brain injury,” he said.
Unfortunately, he added, it often closes the doors to many rehabilitation centers.
“Most of the rehabs aren’t equipped for that kind of thing,” he said.
Nick’s parents have scoured the state for a rehabilitation institute that would take their son. There are options out there, such as the Center for Neuro Skills in Bakersfield, but the issue is money.
As a part-time employee for the city of Santa Barbara, Nick doesn’t have health insurance and is only covered by Medi-Cal.
He received a small amount of money from the Victims of Violent Crimes fund, but it wouldn’t cover much more than a month at most private rehab centers.
Paul took vacation and sick leave from his job as an irrigation technician at city schools during the first few months. Since then, he has returned to work intermittingly, but he doesn’t have the kind of money it would take to get his son into a decent facility.
Faith, a marriage and family therapist, can’t afford to pay for private rehabilitation either.
And because Nick’s injury is physical in nature, he doesn’t qualify for mental health services.
“They just split hairs and he’s just falling through the cracks,” Paul said, tears welling in his eyes. “He needs help. I can’t afford to pay for it.
“It’s been like six months of living hell. I’m a man’s man. I don’t want help. But we’re desperate at this point.”
Family members established a fund at Santa Barbara Bank and Trust — the Nick Cavalier Rehabilitation Fund. Donations will support his recovery.
For now, Paul is still working on getting his son out of jail and into a place where he can receive proper rehabilitation. He just wants to see his son happy and carefree again.
“Maybe Nick will never understand,” he said. “I don’t know that. But there’s a good chance that he can live a good life. He says to me, Dad, I just want to be at the beach. I just want to be hanging out.
“What happens to him in the next six months to a year is critical to the rest of his life,” he continued. “That’s the thing that motivates me to get the help he needs.”

What a terrible story! I am so sorry for the family and for Nick! Surely, since some of this started because of Cottage's negligence, the male nurse abuser at the Cottage Rehab Hospital, surely, Cottage with all of its $millions$ raised in town will stand up and help? Yeah, right. (Whatever happened to the nurse, hand slapped and he transferred to another facility?) (Btw, I wonder how many other incidents there have been of Cottage negligence; it would be a valuable story.) Just awful situation. Thank you for publishing. Kind thoughts for Nick. I suspect many of the county sheriff jailers, used to working with difficult people, are kinder than Cottage management (and some staff.) Maybe some rich angel will see and help. Wow what a terrible incident to happen to such a young local man. I recently spent spent a a week in this beautiful beach town. Enjoying the local entertainment, parks, county, and zoo. I have Two boys of my own and I can not imagine the hell that has plagued this family. Well I was here I read in one of the local Papers (Independent) that Oprah Winfrey who is apparently a part time resident of Santa Barbra donated One million dollars to this hospital where all of this neglect took place. It seems to me this hospital should be accountable for their acctions and help this family out. Its unfortunate that a well funded hospitals can not offer the adicute care that this young Santa Barbaran needs. Further more im disscusted with this staff member who has pressed charges against a blind brain injured pattient, who has no control of his feelings and emotions. I feel this person is heartless and has no buisness working in the health care feild, this would seem like nursing 101 that a person with a brain injury would act this way. This seems to be a very low point in cottage hospitals policy's (shame on Cottage hospital and the staff member who put this man in jail, shame on you) Clearly this young local man does not belong in jail. With Traumatic brain injuries on the rise from the War and sports injuries you would think the only hospital in town might see the righting on the wall and hire competent professionals who are familiar with these types of pateints. Cottage has great ICU employees and great staff in other departments but why not nuero patients rehab. it seems they might be suffering growing pains at the cost of the patients. This to me seems to be a administration and management problem. We should all remeber even though they are a not for profit institution they sure have alot of money and power in this town. We all have seen where that has led this country lately.Give your children a hug and some love today because you just never what tommorow has instore for them. How many lives have to be ruined before our Mayor and Police force get a little more serious about gang issues in this town? What a horrible, horrible, thing for Nick and his family to have to go through. I ask myself, did this have to happen..........is the very maximum effort being employed by our city to eradicate these violent gangs? Little kids are killing each other, all sorts of lives are being destroyed, our scenic town is becoming a battleground................... so at what point is it "serious" enough for the mayor and police chief to take serious action? There are gang initiatives out there that are meant to deal with exactly the problems we have, tactical solutions that deal with the gangsters in a direct manner to get them off the streets. Yet our city officials keep saying that it would be unfair to "target" specific neighborhoods and instead choose to continue the course of youth programs and job placement as their solution to the problem. In other words, their policy is to do absolutley nothing. We have around 1000 gang bangers in this town, educating the children and giving them summer jobs is very clearly not effective in the slightest . Kids, the very age group targeted for the city's "help", are getting stabbed in the busiest parts of state street and at our city events like 4th of July. If these are not indicators that much, much, much, stronger action needs to take place........then nothing will be. I find it ironic that our city jumps all over the problem of teenage drinking with speedy pasage of the social host ordinance putting pressure on parents to raise their children responsibly..................does the city's gang problem not warrant the same type of urgent attention and legislation? Why in the world can't we put the same kind of liability on the parents of these kids commiting violent gang crimes?

I wanted to thank Eric Lindberg & the Daily Sound for recognizing the importance of this story...Our family has been inpacted in such a way that I'm not sure if any of us will fully recover. A day hasn't gone by that I haven't thought of Nicholas or that my heart hasn't ache for him. I remember Nick always tring to be the peace maker...I just don't understand...He is so underseving of this crime and it angers me that he's having to suffer in such a way. It breaks my heart that I couldn't be there to protect my little brother. To me he will always be my little brother...funny as all hell, loving of life, passionate about surfing and his family. You will comeback to us...I miss you Nick.

It is absolutely tragic that Nick is behind bars while the people that did this to him are still roaming the streets. Nick does not deserve any of this. It angers me to see him in this state, knowing that justice has not been served. Since I first met him, he has always been such a great friend, always loving and nice with everyone. Nick's behavior in the hospital is due to his injury. To put him in jail instead of providing him with the assistance he needs is an issue that I hope the community of Santa Barbara will confront. i want to sat that, first off nick we love you and are praying for your recovery. it will come in time, but dont worry, it will come. I dont think that wether or not the "boys" who did this legal status is of importance. i say this because it goes deeper then that, being as a local my entire life, born and raised, i have seen this town totally forget about the "locals". a real sb local doesnt need a saks or a tiffany or juicy or a&f, like nick, myself, my kids we need the beach, the mountains, the skate park, baseball parks. things for the younger generation to do so that they arent bored and get into fights. who does this town belong to anway, the people with all the money to buy land to build so there are no more mtns or beach ot to the locals like nick. Also one of the main problem is that he would have been and should be on the roasd to recovery but the ones who are taking care of him and trying to get him back to some normalcy{whom im sure are leagl us res.} are the ones on a daily basis beating him down. and isnt it the people who work with brain injuries the first ones to know what the actions are and the behavior and should be better informed and equipped to handle the situation rather then having him arrested. i have know nick for about 14 yrs and this is not him. he deserves as a human being to be treated and cared for as the rest of us would expect, and santa barbara should foot the bill for a true SB LOCAL, as he is. IFor how much longer must we watch as Mayor Blum and alleged "Top-Cop" Chief Sanchez BOTCH the SB gang problem. Stabbings on the West Side, on the East Side, NUMEROUS stabbings on State St, and now a good local kids' life in ruin. Meanwhile, we're told we should spend millions on programs to keep these animals occupied, as if that will help? Deport their parents and lock the kids up and I guarantee better results than setting up playdates for them. I am as liberal as it gets on most issues, but my bleeding heart doesn't obscure the reality that the source of the SB gang problem is the children of Mexican immigrants, most of whom are illegal. Much more of this and I will take action myself. Hey SBPD, time to start profiling! You stop every young Mexican in baggy clothes and shake them down and we can put their a*s in jail before they hurt my kids. I assure you that any "innocent" victims of such profiling will figure it out quickly and change their image for the better. If middle aged white American men in khakis and Hawaiian shirts go on a crime spree, you won't catch me complaining for getting caught up in a dragnet to stop the problem.

I would like to say Aloha and Maholo to Eric Lindberg for writing and reporting this painful story. Nicklaus is a great person with a big heart and a carring spirit. This carring spirit really shows in has actions and Jobs that he has chosen to work over the last four years. Such as working as a counselor with young people of Santa Barbra to umpiring youth baseball games as well as woking the parking lots in down town S.B. My wife(Nicks sister) myself and our two boys live in Hawaii. Two summers ago we invited Nick and Patrick out for the summer to work with me. The boys came out and stayed Patrick lasted the whole summer and Nick left after a few weeks. Nick was home sick and missed his town, Santa Barbara. He was and is still very proud of his town, the culture, and the people of this beautiful place. When I would come to town we would always go down to Leadbetter Beach and check the surf, Nick loves Leadbetter beach and the Mesa where he grew up, this was always clear; Santa Barbara is his home Born and raised. Nicholas breathes Santa Barbara from his care free spirit and beach life style to his love for the mtns and Islands that surround this magical jewel. My hope is that the people of Santa Barbara can get together and help my young brother out by getting him the care he needs to once again breath the air that you the people of Santa Barbara cherish as residents. It seems we need also to have a series of meetings in effort to notify the community as to what is really going on at night in downtown Santa Barbara. It appears the media keeps a cap on reporting these occurrences, is it bad for tourism? This is a tragic story for a wonderful Santa Barbara family. I have witnesed how much this incident can change a life having watched Nick's family try to come to grips with this. How sad to have this happen to a family. How hard it must be to celebrate a Thanksgiving, Christmas or Birthday when your child is not around to celebrate with you....It is in the back of everyones mind always who wish they could have taken back that moment in time that evening... We all wish we could protect our children from these awful events as well....It is children who have so much to live for being snuffed out by those who really could care less about life.. how sad is that. Thanks Eric for bringing Nicks story to light. It has been a frustrating time for all of us in his family. I want to point out to some who might find outrage in the responses to this event, that my brother Paul never once mentions retribution to the sad people who did this to Nick. We were not raised to look at peoples skin color or the status of their immigration, but have over the years become aware that "times have changed" with all of our youth. As teenagers we were immortal and couldn't fathom the fragileness of our life, as the young man who kicked Nick misjudged the fragileness of the human body. We pray for Nick every day, and we thank God he is alive and has a chance at recovery. He has taught me a lesson in what it is to be strong, to be a man, and to be thankful for what little comfort you can find in a day. He came to the aid of a friend...regardless of the wisdom or lack of wisdom they together possessed. His frustration is due to his limitations placed on him by his surroundings, not his obvious infirmities. And he is truly thankful to those who have tried to help him, both in the hospitals and in his family...which he described to me as his "true strength". I want to thank all who have made an effort to help Nick, and recognize that in every field we can find Hero's and Villian's. Santa Barbara has plenty of Hero's in it's population. They are the witnesses who tried to help him, the health care professionals who saved him, and the law enforcement officer who continue to try and help. We choose to recognize those Hero's. We will continue to have faith that Nick will be well and will eventually heal, as will Santa Barbara and it's residents. God Bless you Nick

Somebody needs to make sure all the financial supporters of Santa Barbara Cottage Rehabilitation Hospital are aware of the wonderful job their money is doing at that establishment. Allowing people to get beat up, and mysteriously having patients jailed sounds pretty sketchy to me. Elderly and handicap abuse happens daily. This needs to stop. AND for those of you that are withholding crucial information that you witnessed on June 7th, I hope you experience the same pain this family has had to endure because you’re too cowardly to step up and tell the truth.

Thank you Eric Lindberg and the Daily Sound. The GRIEF, PAIN ,SADNESS, and HEARTBREAK , that Nicholas and our family has suffered from this senseless act of violence, are undescribable. Nicholas was such a crusier. All he wanted out of life was to surf and be by the ocean. He was happy living minamally. Several times a week I would see Nicholas crusing on his skateboard, while I was delivering mail and he would yell "Jai , I love you." And skate on to work or home. The second time nicholas was re admitted to cottage, I went to go see Nicholas,and was not allowed to see him. For reasons unknow to me, they said I had to be on a list. When I called my mother she said there was no list. The hospital was denying a paient a right to family visitors. It saddens me to see that a city so rich with life , people and influance that there are so littlle options for my brother in the proper care treatment and help he needs. Thank you SB Daily Sound and Mr. Lindberg for writing this article and sharing with our community the pain and frustration that Nick and our family has been dealing with. It saddens me to see that the community that my brothers and I were raised in and the community that Nick has grown up in has turned so hateful and disrespectful. We were never taught to hate, we were raised to be respectful of other human beings and these beliefs we have past on to our children. I have such a great love for my nephew, he is an awesome kid with a great sense of humor and a true love of life. The senseless act that has put Nick in this situation is truly horrible; however our focus is on "Nick" and his recovery not on retaliation. Nick has tried so hard to be positive and to accept what has happened to him but at times due to his brain injury he still believes he can do all the things he use to do and that can be extremely frustating for him. One day while visiting Nick, I asked him what he'd like me to tell people when they asked about him and he said "tell them thank you for thinking and praying for me and to keep thinking and praying for me". Nick often talked about what he could do with his life when he got out of the hospital - he has tried so hard to stay positive despite the senseless act that changed his life and the less than humane treatment he has received by Cottage Hospital. I truly believe in my heart that Nick will one day surf again in some form or another because our family will do whatever it takes to make sure that he does! Though my heart is now full of pain and my mind just can't wrap itself around the reality of the things that are happening to Nick I have hope that something will change and Nick will find a place to heal.

Nicholas is a beautiful young man. He suffers deeply and I feel brokenhearted. I am his mother. I don't even know how to express the depths of my feelings for my son Nicholas. I have seen him comatose. I saw his eyes blow out when his inter cranial pressure shot up so high he almost died on June 13th. I have seen him like a noodle when he came to and sat up for the first time. I have seen him in restraints. I have seen him sob in anguish. I have seen him held down to the ground by rehab staff. I have seen bruises and scratches on him. I have seen him so doped up on psychotropics he slurs. I have see him in jail. And I have protested and protested. All this is not right. He needs to be safe and well. I am glad you all know something about his situation. Hopefully this article will get him the help he continues to need. I appreciate the comments of concern and obvious love I have read here. It is good to know people care.

Nick ---- you've got a compassionate father, strong mother, sweet sisters, a cadre of cousins, aunts, uncles and grandparents who weep for you - and wish for you. In many cases this is enough, love is enough, to heal physical wounds. Somehow I thought it would work this way and you would be well by now. I'm sorry that you've seen dark days when you should have been experiencing a rebound. But, we'll wait as long as it takes Nick, so that you can get some proper care. Traumatic Brain Injuries (TBI) are just that....traumatic. But you're going to be sitting by the ocean again someday. It's going to take more time, more hassle, more pain...and it shouldn't have to. My brother was badly injured by a drunk driver...he was in a coma for months...supposed to never walk or talk again if he did survive...he did...he is wonderful...its been a long long road for Sean but with love and proper care he is getting better everyday.

Bllum and Sanchez are as much to blame for this sad state of affairs as anyone. The fish stinks from the head, and all of the rhetoric in the world does NOTHING to prevent this sort of thing from happening over and over and over again. The morons walking the street who perpetrate this sort of crap need to be sent away NOW. Read them their rights and get them into their orange jumpsuits of "honor" as quickly as possible. I happen to have been Nick Cavalier's Pony League Baseball coach way back in "the day", and I remember him very well. Both he and his dad were the kind of people with whom you want your own kids to associate. "Salt of the earth", unpretentious, generous, community-minded. There will be those who will give Nick some of the blame for what has happened to him, because he was upright enough to try to help a perfect stranger out of a bad street situation...which is, quite frankly, bullshit. Nick is the kind of boy anyone would want as his own son, and he does not deserve anything but the best. Sadly, Blum/Sanchez/et al do not have a clue of how to provide that. They only know how to waste taxpayer dollars with their ongoing boondogles. Who will step forward to organize a community FINANCIAL effort to help the Cavaliers out?

What happened to Nick is sick and outrageous! Sending a brain injured patient to jail? What has become of the nurse (or whoever) who abused him? Cottage Hospital should be sued by the family. Jail is certainly no place for this young man to convalesce. How can this have happened? I'm beside myself with feelings of helplessness and rage! Think of it people: this could happen to ANY one of us. The escalation of gang violence on our streets in the last couple of years is bad enough and has got to end, but to be abused in the hospital and sent to jail?? WTF? First, thanks for posting this Mr. Lindberg. Never ever would I have thought I'd be reading a story about Nick being in trouble for violence. Maybe in trouble for goofing around or joking. I cannot express how bad I feel for Nick, his family, and anybody still lucky enough to be close to him. If there's any bright spot at all in all of these, we all know what kind of person Nick is and hopefully that same soul, character and person will rise above all the undeservingly bad things that have happened. Our hearts ache for Nick and his family. We can fully understand the anger and frustration being experienced by Nick and his parents and hope that publicizing this out-of-control situation brings some light to issues encountered by many survivors of Traumatic Brain InjuryI. Our son suffered a severe TBI in 1992. Although he received good physical care, we were greatly relieved to get him out of Cottage Hospital's CCU and up to the Rehabilitation Institute, then a separate entity from Cottage,. At the "Rehab", under the direction and guidance of top-notch staff with extensive experience and training in the area of brain injury, he could begin his long recovery from the TBI. Recovery from TBI is slow and ongoing. Nick's behavior is absolutely related to his brain injury. Restraining him and having him arrested exemplifies the ignorance of some of the Psych Unit staff members we encountered during one of our son's stays at the hospital following a suicide attempt. Although they may have some success with patients with drug, alcohol, suicidal tendencies, depression, etc., in our opinion, the staff of the Psych Unit at the hospital was simply not competent in the area of brain injury nor were they staffed to handle the needs, both physical and psychological, of the brain injured. Overall, we believe Cottage and most of the doctors associated with the hospital offers good care to our community. There is, however, much room for improvement in educating it's staff in the area of assisting and understanding the needs of individuals with acquired brain injury.

This will be my one and only response to those negative persons who have posted or will post. Many of us close to Nick have seen first hand his good treatment and his bad treatment and have evidence to back it up. He was treated extremely and made leaps and bounds towards recovery early on and was still progressing at an appropriate rate for his condition until certain individuals started treating him. The facts are my cousin is in jail with a brain injury and blind instead of being treated like a patient who needs to be healed in a hospital. If you feel like you are the ones that have been wronged by a one sided story while you are sitting at a computer you can see clearly and type on with no problem think again. We have heard the TRUTH, we have seen the TRUTH, and Nick most of all has felt the TRUTH you claim to know! The irresponsible abusive parties will be judged in this life or the next that is for sure. Your comments are weak and unsupported to say the least. You cowardly hide behind your initials or nothing at all, while continuing to defend yourself or someone you know. Nick is still strong and continuously faithful and he will recover despite the lack of treatment he has recently received. We as a family are also strong and faithful and will continue to remain all the way through your comments and this whole ordeal. Its unfortunate that Nick has to go threw such a hard time. Not just Nick, but is family as well. It's heartbreaking to know how a close friend of yours, one who you shared good times with, is going through such hard times in his life. As hard as it is to understand Nick's situation, and to have to go through such hard times as Nick and his family are going through, there is always light at the end of that long and dark tunnel. To Paul, Faith and the rest of the family, there is only one thing we can do to help Nick out. As a believer and a follower of our Lord Jesus Christ, I have learned that prayer and faith are the most important tools we can use to find the answers we are looking for. Paul, Faith, and the rest of the family, although it's hard to see you son/brother in such pain, keep you spirits high and put your faith and prayers in God's hands. God sent his son to die on the cross for all of us. One of the things Jesus died for was for our sickness. God can heal and return Nick's eye site to complete normality, even better to how it was before. He can heal his brain and completely transform it to something new. Return Nick to a complete normal state and even better as if nothing ever happen. Believe in Jesus Cav family and accept him into your heart if you havnt already. truth you must be a cottage hospital employee because anyone who truly knows Nick knows that he is a nice guy and I personally have seen how he was treated at the hospital and I know the truth! nurses aides are not trained to deal with brain injured patients they are trained to feed, change, and sit with patients who are recovering - for some reason probably monetary cottage hospital has certified nurses aides whom are paid and trained the least doing most of the patient care. if you do not know anything about traumatic brain injured patients how are you suppose to know how to care for them and most of all how do you know what kind of person they are when their brain function is compromised?

"For those who know Nick and grew up with him, jail seems to be the last place they’d expect to find the 22-year-old." Please. This is total b.s. I feel sympathy for his medical condition, and the sad state of his life, but this article is a gross exaggeration of his innocence. Deep down he may be a good person, but he has made some stupid decisions and done some criminal things, and I urge everyone who reads this article not to take it at face value.

I feel the rehabilitaion center was way of out line causing him to become agitated. The employee who harassed NIck should be fired. Brain injuries are very difficult and i'm sure your behavior can become irratic. To put this poor boy in jail is absolutely ridiculous. Shame on the police department. What if this was your child. Here are a couple of tidbits of "Truth" for you; 1>Nurses don't go to medical school - they go to city college for a couple of years. Most of them are fantastic, wonderful, caring people, but they're also human. 2>There is NEVER a reason for anyone on the medical staff to hit a patient. Are you KIDDING me? The negative responses from some posters are to be expected - some people are just miserable like that, and they are to be pitied. It must absolutely SUCK to go through life like that. WHY? that is a good question truth? why do people do the things they do,? why are our teenagers fighting in the streets and killing each other? why do medical staff whom are suppose to be compassionate and caring individuals mistreat patients? fear? ingnorance? incompetence? stupidity? hate? maybe just being human - people are not perfect they make mistakes! Nick is a human being and yes he too has made some mistakes and he has learned from them but he is NOT a criminal nor is he malicious - he is a person with a enormous heart and a tremendous love of life, the surf and the sun. He is also a young man who's life has been severly altered by a senseless act of violence - why? why does a hospital with so many resources not train their employees properly and why on earth would they have a patient in their care sent to jail?? why are you so upset about the outpouring of love and support for Nick? As an independent independent nurse care manager for almost 20 years, I was an advocate to help people like Nick navigate the medical and insurance system. This is truly a sad story and it is likely not the whole story. The majority of nurses in acute rehab facilities dedicate themselves with enormous compassion and patience as well as risk of bodily injury due to the typical compulsive and unpredictable behavior of patients with brain injury. There is so much grief and anger for the patient and family to deal with and often identifying someone to blame is an unfortunate outlet. I truly hope that Nick and his family get the help that they need.

Most people know TBI causes aggression - so why is this kid in jail? And I'd be aggressive too if I was being mistreated... never mind if I had TBI. This needs to be looked into further...Cottage had a chance to comment... NO comment makes me wonder. Where's the followup? And IGNORNING the gang problem is only going to lead to more tragic stories like this, I know another "kid" who was beaten senseless by gang-bangers and almost died in hospital because if it. Obviously Nick & friend shouldn't have engaged with the gang bangers--but we weren't there and we don't know what went down. My young friend was just walking home late at night. Minding his own business. What's happening to this town? (I too have roamed the streets a bit tipsy in my youth... I didn't have to worry about GANGS.)

I know the Cavalier Family but have not had the pleasure of meeting Nick, but, knowing his father and his Uncle Joey, I have heard of Nick. The fact that Nick was sentt to a rehabilitation center and abused in such a way is a second tragety to his initial injury for sure but, the cavalier way in which they addressed this issue is a third tragety. That "nurse" should never be able to have another patient put in his care. Restotution should also have been made and proper care given but none of this was done in hopes that this famliy who ahd sufffred so much would just go away. What also strikes me oddly about this tragety is that there is no mention of wither or not the Hospital alerted the Police of Nick's condition. If the hospital failed to inform the Police of this, they are also liable for additional negligence. To have him arrested without taking into consideration the documented agressive behavior for those who have suffered brain injuries is a further travesty. Thank God Paul had friends at County who recognized Nickand gave him the first care Ncik received in all this. Cottage Hospital should be renamed "Nicholas Cavalier Hospital "when his lawyers are done with the case. Gob Bless you and your family Nick, be strong, you are in our prayers.

Lack of Awareness, Funding and Services : 1/8/2009
The reason I am starting a home in Ventura for head injured adults is that a return to family and a semblance of the life before traumatic head injury does not exist. The survivor of an acute head injury (sometimes quantifiable by length of coma) is not the pre-morbid individual. Brain injury may soon be classified as a "disease" because once it occurs, the person is suseptable to seizures, violent or promiscuous behavior, ataxia (lack of balance,) poor judgement often resulting in secondary injuries, poor executive functioning and money management, speech problems, memory problems and fabrication. Add to this the challenge of living on SSI disability and the outlook is very bleak. The story of Nick is deeply disturbing and should be presented to our new president along with millions of other people in need of medical services. This is being done at the National Brain Injury Association level, but not fast enough for Nick. At the local level, we can support our chapters of the Brain Injury Association Santa Barbara (Jodi House) and the Ventura Brain Injury Center to educate the public, law enforcement and rehabilitation specialists about the effects of brain injury. I would like to see education on prevention also spread among all elementary school children. We can make a difference in the incidence of brain trauma and the humanity of the outcomes.

"Did before"? What Nick "did before" his brain injury is good stuff: he was a kind and generous boy who grew into a life-loving young man. "Before" his injury he volunteered his time year after year to help youth in our community. "Before" his injury he was walking and happy and working and going to school and surfing and, oh yeah, he could see. What has happened to him since his injury? (an injury that was inflicted because of what he "did before"- HELP HIS FRIEND! ) He was on course for recovery, but apparently if you don't have insurance, you don't receive quality care long enough to recover or even rehabilitate. Does Nick have a right to be upset? Hell yeah!! But the Nick "before" would never act out. What Nick needs now is the love and compassion that he spread to everyone he met. He needs help to get the help he needs to rehabilitate. Nick is a true giver who comes from a family of givers- ask anyone who knows them. How can we help??

you last comment just proves that most of the staff caring for Nick at the rehabilitation institute and cottage hospital 's patient care ward do not know anything about caring for patients with traumatic brain injuries because if they did they would not have taken anything he may have said or done PERSONALLY. he does not have control of his thoughts or actions and he can't even see you! i say "most of the staff" because Nick did have a few nurses and aides who really got it and knew how to care for him and he loved them very much - funny he rarely had an outburst when they were caring for him. no matter what he did if you are a "professional' you do not physically or mentally abuse a patient in your care for any reason what-so-ever! also thank you Peggy Harris for your informative comments and for you pursuit in starting a home for people suffering from TBI's.

SERIOUSLY /B/ did you read this article? according to the police reports & eyewitness accounts, though some were sketchy...this is what happened. Why are you trying to paint my brother in a ny ugly light?! Maybe nick wasn't excatly a saint, but who is? Are you? I guess I don't understand what you are trying to prove. The purpose of this story was to bring awareness & light to Nicks stiuation. BOTTOM LINE Nick needs help through this recovery process, emotionally, physically & financially. I would like to thank those who made this article happen. As a part of Nick's extended family, I see from the sidelines what this is doing to his Mom, Dad...all of us. He is a great kid, yeah he's a kid, but he's a loving, respectful and caring soul who does not deserve to be in this unfathamable situation. I know both sides- i also know Nick has a brain injury and not to take his actions personally- he needs help, he deserves help. He is a good person and i pray that he gets into the right hands and gets the help he needs.

Like you our family has also been affected by TBI. Our son 18 at the time was involved in a motor vehicle accident that nearly resulted in his death. He lost his vision and doctors can't tell us why what else is new. We have met alot of professionals who for lack of another word are (stupid). We have had to fight for everything we get for our son. Our health system here is a laugh. So I can feel your pain and wish you the best. Keep fighting because we are all that these boys have. We live in Canada and have an even less chance of receiving help than your family.

Somehow, someway everything happens for a reason, in God's World. I sometimes don't believe the very words I write. Nick, you may not remember me, I used to play softball with your Dad. You were'nt much more than 10 years old. So sorry for what you are going through now. It's nice to read about how you have grown and matured over the years. I'm just glad you have progressed since I first heard of what had happened. Thank God you're alive! It seems a bit strange that you go from a coma, to having no sight, to being mistreated by hospital staff, to then end up in jail. Somethings wrong people!!!! Hang in there Nick, there's light at the end of the tunnel! Paul, I love you. I hope to I have half of the strength, faith and determination that you have. I am in total shock. My mom just told me today what had happened. I live in Ventura now so I have not been seeing all of my buddies as often as I wish I had...especially Nick! I have known Nick for many years, infact our parents went to school together also. Nick played Baseball in H.S. and I played Softball. We would always go to eachother's games and show our support. He is by far the most awesome and caring young man that I have had the pleasure to be friends with all of these years. Nick really was always the Peace Maker in every negative situation he came into contact with. I cannot imagine what he has gone through and continues to go through daily. My heart just breaks for him and his family. Noone...especially somone with brain injuries deserves to be treated this way. Is this even legal?!?!?! Can anyone imagine what he must be going through!!! Confused, uncertain, alone, scared, blind, in pain.....and he's in jail for what?! I would have kicked that hospital staff's ass if someone tried to restrain me too! and I don't have brain injuries! I cannot tell you how angry I am to know this is happing to such a sweet, loving and caring person such as Nick. Someone has to read this and have enough money to help him out. I met Nick while we were young, playing baseball from little league all the way through high school. I've been a good friend of the family, mostly because of Nick and his dad’s genuine kindness. I hate to hear about him like that. Nick was always the most laid-back person you knew. Ofcourse you can never be sure but from the sound of things, his recent aggression is obviously a psychological symptom of his injury, it doesn’t take a doctor to know that, but apparently the folks at his rehab hospital don’t have the knowledge to deal with the issue and that is a shame. My thoughts are with the Cavalier family. If anyone has the resources, please help them through this tough time.

This story made me so sad. My 28 year old daughter suffered a TBI from a car accident a year ago today. Although her condition is not exactly the same as your son, there are similarities in some of the behavior you describe. Hang in there, it does get better. Doctor's have told us it take approximately 2 years.

While reading the article I felt so much empathy I considered donating. Then after reading the racist and hateful comments my sympathy was waning. Then the blame game made me sick. Your city council and police chief are no more to blame than Nick. The "gang-bangers" or our Mexican youth are just as much a victim of our syruppy lop-sided selfish representation bodies of government as anyone. After reading the comments, including the "prayers" and the evocation of "god" it became clear the no one needs my money. In the end I'd bet that the government will end up taking care of Nick but only if you vote correctly. Lastly, perhaps we spend too much time playing on the field or surfing.

A tragedy of epic proportions for any family to endure! The "Cavs" are definitely strong to be sure but the bottom line is that Nick needs specialized care, quality medical care it seems is beyond the reach of the average family and so it is with ours. He certainly deserves better care than he received at Cottage Hospital. For the major hospital in Santa Barbara, their attendants definitely need to be better trained in how to care for patients that have brain injuries. Abusive care should never be tolerated in any form and if a patient receives such abuse, stronger actions need to be taken immediately by the facility involved! And why hasn't the Santa Barbara Newspaper come to the defense of one of their own citizens? Hopefully their is an "angel" out there somewhere that can, in addition to the trust fund being set up, help financially to get Nicky the care that he needs in a facility that deals in an appropriate manner with this sort of medical problem. Nicky is a vibrant and loving young man who will definitely add much to society if he is given the proper care and rehabilitated in the proper facility. Our thanks to Eric Lindberg and The Daily Sound for caring and taking the time to publish this article. And thanks to everyone who has taken an interest in Nicks predicament and taken the time to post their concerns. We will not however thank the detractors who although entitled to their opinion offer nothing positive.

You are so right about this gang activity that is going on. I really think that these kids that are dressed like it should be harrassed by the law inforcments to wear diffrent clothes and any kids out after 10pm should be take to juvi and not alllowed on State Street and these parents to these gang members have to stop turning a blind eye to this sort of behavior and how they claim the streets and they dont even pay taxes isnt that just a ignorance. I am just heart sick over this entire chain of events that has happened to Nick and his family. God bless you all and may Nick recover soon. I will keep him in my prayers. I have been a patient at Cottage Hospital at least ten times in my life and have never had a bad experience. I am sure this is an isolated incident and God help the hospital worker that would do such a horrible thing. We all pay in the end......Cottage is a wonderful hospital.

this piece of unhumanity that did the kicking I suppose is free and roaming the streets. i have a fantasy that I wish became a reality. When some low life punk does this to some innocent, a gruop of well trained vigilantees go find the scum and do it to him only double. this is my dream for justice, of course it will never happen, but I sure would like to see it happen, I would like to be one of the vig's but my age would prevent that, but we can dream.
