Supes to take on pot dispensaries

County of Santa Barbara officials appear poised to join their counterparts in the city of Santa Barbara on the lengthy, and nearly always controversial, path of crafting ordinances to deal with medical marijuana dispensaries.

The Board of Supervisors today is scheduled to hear a report on the dispensaries, of which at least three exist in the unincorporated county. It’s difficult to know what the discussion could spawn, but the Board will likely direct its staff to return in February with ordinance changes aimed at regulating and restricting pot shops, or banning them all together. The Board could also consider implementing a pot dispensary moratorium.

Until now, the county has been largely absent from the discussion on marijuana dispensaries. According to a board agenda letter prepared for the meeting, the county’s land use and development code “does not list medical marijuana dispensaries as an allowed use nor does it define medical marijuana dispensaries.”

Dianne Black, director of development services for the county’s department of Planning and Development, said as long as marijuana dispensaries are located in spaces already used for retail, no permits need to be issued.

In the case of a proposed dispensary at El Sueno Road and Calle Real, Black said a permit had to be issued because the location was zoned commercial, not retail. This permit was approved (it is now under appeal) after planners determined the retail use complied with county parking ordinances, the only restriction that marijuana dispensaries are currently subject.

Black said this is exactly what the supervisors will look at: whether marijuana dispensaries should be subject to other considerations, like restrictions on location.

“They’re just considered pretty much like a retail establishment,” said 2nd District

Supervisor Janet Wolf, who with 4th District Supervisor Joni Gray, had the item placed on the Board’s agenda. “There hasn’t been any guidelines … Sometimes they don’t even need a permit if it’s the same use.”

Black said the county has fielded inquiries from potential dispensary owners about new locations in Orcutt, Los Olivos and Santa Ynez, though none have yet materialized.

For the last year and a half, the city of Santa Barbara has grappled with its own pot shop ordinance. Today, city leaders are expected to place a moratorium on new dispensaries until tighter regulations can be adopted.

Other communities, like Goleta, have also dealt with issues stemming from the dispensaries, which critics say increase crime and the drug’s availability to youth.

Citing issues with dispensaries in the city of Santa Barbara, Brian Sarvis, superintendent of the Santa Barbara School Districts, wrote to county leaders to advocate for an outright ban on marijuana dispensaries.

“To date, nothing has been done to protect our students in Santa Barbara and we are concerned that the problem will soon extend to the unincorporated areas,” he wrote.

Sarvis goes on to say that students have told him marijuana is “easy to get,” and one even apparently said he could buy a prescription.

“Please protect our children by banning dispensaries in our unincorporated areas,” he wrote.

Meanwhile, proponents say marijuana, and the places the drug is distributed, help them deal with countless ailments, like pain and anxiety.

The Board meeting starts at 9 a.m. and is being held at the Betteravia Government Center in Santa Maria. The marijuana dispensary item is second to last on the agenda. The meeting is shown live on channel 20, and also streams live at www.countyofsb.org.

Once again, our community mourns the senseless death of a young person due to the mixture of alcohol and driving ("Ex-River Hill player charged in fatal DUI," Nov. 30). Even though we continually try to educate and warn teens about the dangers of drinking and driving, it still remains the leading cause of death for the 15-to-25-year-olds. Every weekend there are parties held where underage drinking occurs and teens begin to play Russian roulette with their lives.

A driver suspected of hit-and-run was taken into custody Wednesday night more than a mile from the scene of an accident where a female pedestrian was injured at Rainier Avenue South and South Andover Street.
Seattle Police said a preliminary investigation determined that the man who was driving was going north on Rainier in a Toyota Corolla when he drove up onto the sidewalk at Andover, striking the pedestrian about 7 p.m. Police said the driver continued north, but was stopped by police near 20th Avenue South and South Jackson Street.
The unidentified pedestrian was taken to Harborview Medical Center with life-threatening injuries.
Police said the driver was evaluated for signs of being under the influence of alcohol and/or drugs. He was taken to Harborview for a blood draw as part of a vehicular assault and DUI investigation.

The Next Step is Important : 12/8/2009

It is prudent that the county take up the issue of MMDs because these dispensaries are spreading across the country like wildfire (and sometimes bring wildfire, http://latimesblogs.latimes.com/lanow/2009/11/santa-barbarabased-drug-investigation-snares-17.html), and bring with them a myriad of issues.
On the environmental front the "grows", as they are called, impact toxicity of soil and water, restriction of our access to and safety in our public open back-country, Mexican drug cartels' threat of violence to our back-country, foothills and roads.
On the health front, as thoroughly demonstrated by the previous comment, we have a serious problem in this country with addiction and drug abuse. Increasing the supply and access to marijuana will not improve our situation. What is needed is less access, more education, more treatment, more prevention. The druggies have been systematically brainwashing us all into the patient, caregiver, dispensary language of prop 215 to support their own addictions. Wake up now before it's too late.

The link you provided and your statement about 'grows' refers to ILLEGAL marijuana grows in our National Forests and on large private ranches. Yes, the Mexican Cartels are an issue...but this is NOT the issue with Medical Marijuana and the Marijuana from those ILLEGAL grows does NOT go to dispensaries, it goes to gangs. In fact, I would argue the fact that banning Medical Marijuana Dispensaries would actually increase that problem as legitimate patients would be forced to buy their medicine from illegal sources therefore giving them reason to continue and possibly expand their operations.

Year Moratorium On Pot Dispensaries Assemblymember Sends Letter
Requesting Immediate Action In response to the proliferation of pot
dispensaries in the City of Santa Barbara, Assemblymember Pedro Nava
(D-Santa Barbara) released a letter today addressed to the Santa
Barbara City Council to enact an immediate one year moratorium at the
Council meeting scheduled for Tuesday, December 8, 2009 (see letter
below). “Unfortunately, prior attempts to regulate medicinal
marijuana dispensaries were lacking and have failed in the City of
Santa Barbara,” said Nava. ”The City Council must take action to stop
illegal dispensaries. The City has the authority to place an immediate
moratorium on dispensaries and revoke the business licenses of those
operating illegally. Pending and future permits must be suspended
until clear guidelines are established on par with state law.” In
1996, California passed Proposition 215, the “Compassionate Use Act,”
an initiative which allows for marijuana to be collectively and
cooperatively cultivated for medical purposes by qualified patients
and primary caregivers. However, the initiative did not legalize
storefront dispensaries that sell marijuana for profit. Guidelines
promulgated by the California Attorney General’s Office in August,
2008, and recent court cases have served to clarify actions allowed by
local governments under state law. A number of cities and counties
throughout California have already used these guidelines to institute
moratoriums and/or ban marijuana dispensaries, including Oxnard,
Ventura, Goleta and San Luis Obispo. Nava said, “Supporters of
Proposition 215 were attempting to permit appropriate use of medical
marijuana to relieve suffering from illnesses. Unfortunately, what we
are facing in Santa Barbara has little to do with the suffering of
sick people. In fact, the backlash to Santa Barbara’s current Wild
West approach is threatening the legitimate use of medical marijuana
and jeopardizing those patients who most need help.” According to
the League of California Cities website, there are almost 1000 cities
in California. Santa Barbara is one of 35 cities in the entire state
that has permitted storefront marijuana dispensaries near schools and
sober recovery facilities according to the Coalition for a Drug Free
California. Santa Barbara has become the central coast magnet for pot
profit. The neighboring cities of San Luis Obispo, Ventura and Oxnard
have all established moratoriums while they either ban or work to
develop new ordinances to address the problem. Said Nava, “The Santa
Barbara City Council has an opportunity to do the right thing to
ensure that public safety and the integrity of our community are
protected.”

There are no controls about who grows the pot, who sells the pot to the dispensaries, what chemicals are used to grow the pot, the strength of the pot, what constitutes a therapeutic dose, no paper trail at all. Legalizing pot is not the issue. Dispensaries and retail sales of pot for recreational use is. For anyone interested in health and wellness, marijuana is not the answer.

Mr. Sarvis got one thing right: We need to protect our children. It's time to drive a wedge between the criminal drug dealers and our kids. Licensing, taxing, and regulating marijuana will put the drug dealers out of business and protect our children. Regulate the marijuana business, medical or otherwise. Closing down the dispensaries will mean MORE MONEY for the CRIMINALS. Mr. Sarvis, let's put the criminals out of business; let's regulate the dispensaries, not shut them down.
It’s appalling that anyone would propose jail time for someone using marijuana on the advice of their doctor.
Both the American College of Physicians and the American Medical Association have expressed support for investigation of marijuana for medicinal purposes. Marijuana in various forms, not necessarily smoked, has been used therapeutically for centuries in many parts of the world. Marijuana appears to provide relief from pain, nausea, and other symptoms, with fewer ill effects and a greater margin of safety than the narcotic drugs commonly administered for pain, and safer even than the non-narcotic drugs such as aspirin, ibuprofen and related compounds that are responsible for a few hundred deaths each year (www.acponline.org/journals/annals/15sep97/nsaid.htm).

I can't wait for dispensaries to be banned and watch every kid in school continue to smoke marijuana day after day....nothing is going to change...this government and whole fiasko is such a joke. Dispensaries make no difference to marijuana access in this town, and I know this for a fact, unlike many of you speculating conservatives that still think marijuana is harmful(sorry if that sounds harsh, but it really is true). Please provide me facts that explain otherwise....and if your going to say it is addictive, I will argue that that is a self control problem just like fat people that eat at fast food spots. I support medical or recreational marijuana, when used responsibly. The system to do this will not happen overnight, and it will take work, but we need to stop fighting the herb all together, and think more about how to allow it to be present in our society in a reasonable manner. You can't fight and uphill battle, because it is a fact that medical marijuana is here to stay, those that think otherwise, it's time to wake up.

The two articles that appeared in today's DP were intelligent, thought-out, and balanced. The recent hysterical headlines of the NP regarding medical marijuana has been akin to Fox News on paper...shrill, one-sided, and inaccurate. There are two very passionate and concerned groups on either side of this issue...the NP's coverage has been irresponsible and prejudiced. Another reason to cancel your subscription!
p.s. - I - and EVERYONE I KNOW - will be voting for Das Williams!
p.p.s. - And, A BIG THANK YOU to Mr. Martin. The hypocracy of these "concerned citizens and parents" is laughable! I don't hear them decrying the fact that there's a liquor store on every corner and that kids are more inclined to seek out tobacco and alcohol for this simple reason! Chew on that one at cocktail time, MOMMY!
