Apartment fire linked to marijuana operation

By ERIC LINDBERG — Jan. 29, 2010

A two-alarm blaze that destroyed an apartment in Santa Barbara early this morning has been linked to an operation to convert marijuana into oil for use in marijuana edibles, authorities said.

Narcotics detectives responded to the scene at 1023 De la Vina St. to assist arson investigators in determining the cause of the fire, which was contained by firefighters to the second-story apartment unit.

"During the investigation, detectives learned that this early morning fire was a direct result of the occupants of the apartment attempting to convert marijuana from a leaf form to an oil," Lt. Paul McCaffrey said. "Inside the apartment, approximately 1 pound of marijuana was located in a fire-proof safe. There were approximately 30 to 40 cans of butane in the apartment."

Investigators believe the apartment's occupants were producing marijuana oil to sell to a medical marijuana dispensary for use in edibles. Authorities arrested Luis Antonio Murillo Aguirre, 30, and Krista Marie Gary, 23, on suspicion of possession of marijuana for sale, marijuana conversion and conspiracy.

Nobody was injured during the blaze, which was discovered by neighbors at approximately 6 a.m. who were alerted by smoke detectors. Fire crews discovered smoke and flames pouring from the middle unit in the three-apartment complex and quickly upgraded to second alarm, bringing in four engines, a truck company, a battalion chief, and an air and lighting unit.

"It was completely engulfed in fire," City Fire Capt. Gary Pitney said. "When our arriving crews got there, there was nobody home."

Firefighters punched a hole in the roof to ventilate the apartment, which helped confine flames to the involved unit. Pitney said the two other apartments were not damaged, and no residents or firefighters were injured during the incident.

Fire officials took the opportunity to emphasize the importance of maintaining a working smoke detector, noting that occupants in the neighboring apartments were alerted to the emergency by smoke detectors in their units.

There you go... : 1/29/2010

This is what happens in towns with unchecked pot shops all over town... It is a problem folks. The town of Humbolt has been trashed by Pot Shops and Indoor growers using residential housing as pot indoor green houses. Hey Santa Barbara Police Dept and SB County Sheriffs Dept... The indoor growers are HERE! Please do some investigating to get them OUT!

Bho : 1/29/2010

No "There you go..", this is what happens when you have idiots trying to make bho (butane hash oil).
Bho should always be made outside away from any outlet or anything that can produce a spark.
And wtf @___@ they were going to make edibles from bho

Tax marijuana, have taxes go towards education! : 1/29/2010

Do people realize how many "gangsters" and gang organizations would fall due to the complete legalization of marijuana. They wouldn't be able to make a friggin profit. Their organizations would then have to sole run off coke, meth, n heroin type narcotics. Stop busting little petty marijuana crimes and take the real criminals off the street! Instead make marijuana legal in Cali. Tax it and have all the taxes going to schools and what not. It's a win win. Give pot heads their weed, give kids their education. Crime goes way down, student success sky rockets. Please people lets get this stuff legalized and get those taxes on it to go back into benefiting communites across Cali!

Look it up. Use it properly.

: 1/29/2010

No way! Don't the dispensaries have to have reputable (as silly as that sounds) sources to buy from? How safe is the marijuana when it's bought from just anyone? A little butane in your "edible"? Poison. This is another reason for legalization. Take the idiot middle man who might poison you away.

I agree, legalize it. When crimes or accidents are reported in the news and drugs are involved, it's never just marijuana. Marijuana smokers don't get high and commit crimes.

Fire damage : 1/29/2010

Um wel...I live behind the apartmet building and I can see the damage from my window.
It is a total loss.
All units are gutted.
The entire property went up into flames in minutes.
Explosions like grenades were heard when the windows exploded.
And there was a huge central explosion in the center second story unitl.
My entire family watched the entire blaze.
Kudos the the SBFD....they chain sawed the hole in the roof in about 2 minutes and the steam created agyeser that shot up and then the crew was able to attacke the fire from within and it was out by 6:20.
It started at 5:50. We heard "get out of the buildingand went to the window...once we pulled back the curtain the blaze was so big it lit up the entire interior of our home.
One thing I noticed...no furniture in the debris...no "solid" property.
I hope the city/state sues these folks within an inch of their lives.
They almost killed us.
We were literally 20 feet away and have small children
The other tenants in the building have kids too.
Shame on you!

Distilleries : 1/30/2010

You don't distill in an apartment- and you don't make BHO in an apartment either- these people give weed a bad name and are basically really dumb moonshiners.

Apparently black market increases with MMJ : 1/30/2010

$700 million grow in the nearby mountains, 2 dead, and house fire on de la Vina. All to provide pot for dispensaries. So dudes, where's the logic in 'legalize it and it puts everyone out of business'? Looks to me like business is booming with a near-legalized med MJ. Your arguments don't hold up. People are getting killed in the mountains, and now a family is nearly burned up for med mj? It's a farce. Life was better under prohibition of MJ.

Realist

Hello Realist : 1/30/2010

Read the quote above yours- if it was legal, corporations would take it over and you wouldn't find undercover operations in apartments.

Ban Campfires : 1/30/2010

These people are not operating legally. First they are in a residential area doing commercial manufacturing, second I doubt their kitchen FDA certified for legal selling of food products. I doubt they are registered with the city and have proper business licenses or i bet the fire marshal would have had something to say about this practice before it happened. The problem isn't legitimate businesses its these fly bye night people that are not registered and regulated. Its fine to grow but make it transparent; where the fire marshal and police officers can go in at anytime but assuring the owner no risk of going to jail. But to be subject to laws as if it was a certified business. These businesses should have to pay a reasonable fee for inspections by the city and extra tax for schools. Big business will pick it up and then raid small time illegal businesses or ones found in the mountains, Exxon does this in Iraq, and has stabilized parts of South America where it operates.

for a better future

never fails... : 1/30/2010

No one was home, no one confessed to actually starting the fire while producing oil ...It could have been electrical, like the courthouse for all we know, or some crazy vigilante neighbor determined to burn them out of town.
But let's not let the "facts" get in the way of these publicity whores! It's not about pot, it's about power and control.

Boycott Boy

Thanks Obama! : 1/31/2010

Your idiotic statements and policies are creating nightmares for normal people who don't want drugs in their lives and the lives of their children. There are now more applications in process for marijuana sellers than the total number of pharmacies NATIONWIDE. As if life wasn't already taxing with the number of drunks and liquor stores you go ahead and tell teenagers that you can now legally deal pot to your high school friends as long as a doctor tells them they could benefit from smoking pot for any reason and the doctor's incentive? Zero oversight, no actual written prescription and a quick $300.00 in cash for each "patient". Just wait until all of these people who start home-based marijuana processing, growing businesses find that they cannot compete and decide to put their equipment to good use doing the "other" things you can do with the same equipment. Cook meth, refine heroin, make DMT, LSD, grow cocaine and poppies. Real bright idea to legalize marijuana. We now get to be a nation of drug addicts. Whoppie

Pull your head out of your.... : 1/31/2010

"We now get to be a nation of drug addicts."
This *is* a nation of drug addicts. It has been for a long time. The demand for drugs in this country is so high, substantial parts of other countries' economies are based on supplying drugs to our nation. This includes pharmaceuticals, too.
If you think only *one* president is to blame for the failure of our drug policy, then you will have to look further back than President Obama. There are cumulative failures of several administrations.

Yes, we cannabis!

Your Law is Subject to Change With Society : 1/31/2010

A person that has a master in chemistry could not take a grow light and convert it to Meth. By the way your kids are all hooked on Ridlen and Adderall (legal speed) then you wonder why they try meth or coke?? Then add the disinformation given to your kids no wonder your worried. how many poppy and cocaine grow bust happen here in the u.s.?? Just be happy we haven't seen "Paco" the new crack. Your kids know to go straight their grandparents medicine cabinet or yours, that's where the killer meds are; anything from Valium to Oxycontin(pharmaceutical heroin). Richard Nixon was the one who signed a deal with the pharmaceutical companies which moved drug dealing into the white collar parts of society. The fact is I am not too lazy to teach my own kids the bad effects of legal and illegal drugs. I also teach them that no matter where you live be it salt lake city Utah or south central LA, that drugs will always be there and why to stay away from them. Plus i bet when micro breweries go out of business they start making crack with their equipment, good logic(""other" things you can do with the same equipment") with no sound basis(semper necessitas probandi incumbit ei qui agit-means burden of proof is on you). By the way dairy and corn farmers are the one's making meth, when stocks are down.

Whats In Your Cabinet??

This is what Trashed Humboldt County : 1/31/2010

The right of Choice : 2/2/2010

For people that choose not to have MJ in their life, that is your choice. Please educate yourself as much as possible to the new effects and side effects of it so that you may educate your children with, so they can have as much information as possible to make an educated decision for themselves. As my Husband and I did. As my choice, I do not partake in the medication myself, but believe it would have been a very good medicine for my mothers anxiety and hypertension now. (she is 89) . And probably would have slowed her degeneration considerably better then the narcotics offered by her physician. For people with chronic pain such as I, I would like the choice if by now it is possible for it to relieve some of the nerve damage I ail from, before I switch to a more potient opiate that is legal, also thru a prescription, such as synthetic herion. Remember folks let people choose their religion, do not knock on my door, and let them be their own guide to what they feel is the best answer for their own soles of their feet.

American Drug War The Last White Hope : 2/3/2010

For anyone who wants the truth regarding this failure of policy in the US, I strongly suggest you go to google video and type in "American Drug War The Last White Hope". Sooner or later we as a nation are going to have to decide whether or not we want to be a FREE SOCIETY as our founding fathers envisioned or another USSR style police state. We now lead the world in imprisoned human beings, ahead of China, Russia and all of Europe combined. WHAT A DISGRACE for the one time LAND OF THE FREE!! That fact is directly related to these idiotic drug laws. The real reason that illegal drugs are a problem is the fact that they are illegal and therefore highly overpriced. This is what creates the bulk of the crime involved here. Marijuana is a friggin' plant that is native to our country.. Why do we need governmental agencies with a sneaky pack of highly paid thugs parading around our communities peering through windows, listening into phone calls, picking through trash, and kicking peoples doors in? End this idiocy and force the "John Q Law" cowboys of this country into getting real jobs.
Heroin, crack and meth are really worth about 15 bucks a pound....Let the market speak here and let the nit wits knock themselvs out. It costs 50K a year to keep each one of the MILLIONS of prisoners created by these laws incarcerated, not to mention the army of federal, state and local drug agents who rack in 80-100K a year running roughshod over and around the US Constitution, destroying peoples lives and stealing thier property as they go while acting like heros. Meanwhile the ones who are making the REAL money are funneling their huge profits through Wall Street banks and buying up the country...This has been going on for centuries...We as a nation must be responsible for teaching our own children not to poison themselves and quit depending on this nanny state mentality....END THIS MADNESS!!!

G Washington

G Washington is right : 2/5/2010

The reason MMJ isn't legal because 2005 Gonzales V. Raich court decision that concluded that congress didn't have the power or control to regulate interstate commerce. Which meant that the congress could not tax mmj without effecting the markets in states that marijuana is not legal. thus effecting Comprehensive Drug Abuse Prevention and Control Act of 1970 made by Nixon which was designed to disrupt drug markets.

About the Article : 2/5/2010

For all i know This article as nothing to do with Marijuana being illegal, all i see here is a 2 people a making dumb decision and their apartment catching fire. For the person who posted about having children and illegal weed blah blah, suck it! Yeah i feel sorry for the kids good thing nothing happen to them. But in the real world, its Kids that accidentally/purposely set fires and people that fall asleep while smoking "Legal" cigarettes. It could be anything that set fires in an apartment, so just be glad that your unit is ok for now, keep in mind there is more people growing weed indoors then u really know :-). And i agree with Legalizing weed for medical use, its natural and better then taking a damn "Tylenol Pill" have u every read the side effects on some on these so called Legal drugs u give your kids?
Educate yourself probably 1 many reason u can control your drug habit now.
