Juarez could get 13 more years in prison

Dressed in an orange jumpsuit, Ricardo “Ricky” Juarez appeared in Superior Court yesterday for the first time since being sentenced to 17-years in prison for the July 2007 slaying of a 15-year-old boy.

Juarez, now 16, has been charged in adult court with assaulting another boy during a brawl in Santa Maria Juvenile Hall on Feb. 15. If convicted, Deputy District Attorney Hans Almgren said it would be Juarez’s second strike under the state’s three strikes statute, which would greatly extend any sentence the boy could receive.

Under the current charges, the prosecutor said Juarez, an Eastside gang member whose nickname is “Lil Theft,” now faces an additional 13 years behind bars. Had this been Juarez’s first brush with the law, the maximum sentence he could receive would be nine years.

Two other boys, Ivan Romero, 17, and Ruben Nicholas Mize, also 17, are co-defendants with Juarez and were also charged with assault and a gang enhancement.

Almgren said the threesome assaulted 16-year-old Daniel Cervantes, who sustained a hematoma to his head.

Cervantes, an alleged Westside gang member, is awaiting trial for murder. He was charged in connection to the July 4, 2008 killing of 15-year-old Emmanuel Roldan.

Mize is awaiting trial on a number of alleged crimes, including a murder charge in connection to the July 2007 killing of 16-year-old Lorenzo Valentin Carachure. Mize is also facing three separate charges of attempted murder, two from the night of the Carachure killing and one from a Jan. 17, 2008 incident.

Almgren, who is prosecuting Mize on the murder and attempted murder charges, said all of the boy’s cases are being tried in adult court.

At the time of the assault, which took place on Feb. 15, nine days after Juarez turned 16, Romero was in custody on charges brought in juvenile court.

As a result, Almgren couldn’t say why the boy was in custody.

The three defendants were assigned legal representation, and their arraignment, originally set for yesterday, was rescheduled for March 25.

Joe Allen, a defense attorney representing Mize on the most recent charges as well as several others, told Judge Clifford Anderson he and the other attorneys were waiting for the prosecution to provide discovery in the case, including a video recording of the assault.

During his trial, Juarez was represented by two public defenders. In court yesterday, private attorney Daniel A. Murphy appeared on behalf of the boy.

In October 2008, a jury found Juarez guilty of voluntary manslaughter in connection to a brazen mid-day gang brawl that left Luis Angel Linares dead.

Mize and Romero both appeared briefly in court last week, but Juarez was not present.

Sometime after the alleged assault, Juarez was transferred to a California Youth Authority detention center in Norwalk, Calif. where he likely would have remained until turning 18. But now, Juarez is back in Santa Maria juvenile hall, the same place he’s been housed since he was 14.

Some Rehab : 3/12/2009

I find it sad that these young thugs are allowed to inner mingle inside when the authorities very well know that they will brawl and enhance there jail time. This is evidence of the Califonia penal system has gutted the taxpayers. They don't care about rehab or reentry into society. The Califonia penal system is guilty of exploiting the crimes and dysfunctions of these criminals to the point of know return. Where people are being wharehoused to produce cheap spare parts for the states many agencies. The 13th Amendment abolished slavery unless one is imprisoned by the state. Yes, the state operates a legal slavery system that uses the penal system to justify the incarceration of many who could otherwise be saved. But instead you have individuals who are forced to perpetuate their street behavior inside and lose any opprtunity to become productive citizens. Yes, there are some who should never see the light of day...but I can say that if the rehabilitation process was holistic in nature, I'm sure that young people like Juarez might stand a chance to be productive one day. It is a true test of survival inside and only a very few make it compared to the number of individuals who spend their lives in and out of jail or dead.

you really think a loser like this and his friends can be "saved"? get a clue. all they are doing, is earning more points with La Eme. that is all it is. trying to prove themselves so they can be soldiers once they are locked up for life. typical mexican attitude. we need to close our borders immediately. we need to spay and neuter anyone convicted of a gang crime. until we take drastic actions, this type of behavior will continue to escalate, until the US is being run by mexican gangs on the west coast, arabs on the east coast, and the chinese in the midwest. sounds drastic, i know. are you effing kidding me? did I say anything about ALL hispanics? of course every race has criminals in it. the bottom line is, hispanics in this town and state commit over 75% of the gang crimes. that is not something I need to "think before I write". that is just fact. Tired of racism, too : 3/12/2009

Wow. Did everyone read the San Francisco Chronicle's article (it was in the S.B. News Press–not too many people working there anymore, they have to purchase all their articles from other sources!)? It is titled: "Washington worried by new global hot spot: Mexico". The article details the horrors Mexican gangs are involved in in Mexico AND the U.S. It's serious. Mexican gangs kidnapping Mexican villagers and smuggling them into the U.S. and forcing them to work the marijuana fields in Northern California. A timber company employee was held at gunpoint by Mexican gang members, and Mexican gangs have had confrontations with firefighters. Hikers may be threatened, the article says. Environmental devastation from destroying the forests for marijuana fields is just total destruction.. Not all Mexicans or Latinos are bad, but I've been at the receiving end of crime by Mexicans in Santa Barbara multiple times, and my experiences are making me flinch more and more these days when I walk by a Hispanic. And that is tragic. I'm not racist, but I am fearful, and so is my child, who gets roughed up by the Hispanic boys at his school (we're talking kindergarten). Few weeks ago a Hispanic boy in my kid's class held on to my kid by the arms, and kneed him in the groin repeatedly – so many times my kid couldn't even count it. He was in pain the rest of the day. This is not normal behavior for a 5 year old. The 5 year old who did this is a nice kid. I really like him. In fact, he's my favorite kid in the whole classroom! (Besides my own, of course.) This boy learned this behavior from someone older, and so tried it out. The influence of gang members reach their little brothers and sisters, cousins, nieces and nephews. No one seems to be stopping it. There is another Hispanic boy I am very fond of. He lives near me. It is so sweet and kind and smart – a really great kid. His parents, however, are teaching him racism, and he's not allowed to interact with me or my child. That is tragic. The very clear message I get almost every day (I live in a largely Hispanic neighborhood) is that I am not welcome here. And not just unwelcomed, but hated. Really, really hated. It's not safe for me to walk the streets in Old Town Goleta. The threats are intense, and scare the hell out of me. My child now fears people with dark skin, and I try to tell him not all people from Mexico are bad or scary. But really, he needs to be seeing that for himself to believe it, and what he sees in Old Town Goleta just constantly reinforces his fear. I wish I didn't have to explain this very dark side of human nature to a 5 year old. While I was writing all this I had to take a few minutes out to call the Sheriff's Department to report a Hispanic man walking down the middle of my street threatening another Hispanic man. It's spring time, things are heating up. With the warm weather, I will be calling 911 at least every few days. I will never feel the same about the Hispanic population after my brief few years living in Santa Barbara. I haven't given up hope yet, however. I am so grateful when a Hispanic person returns my smile and is friendly towards me. The feeling is relief, and gratefulness. And hope that the few Hispanics I meet who are kind and friendly towards me will help to influence those who are not.


Juarez isnt a murderer! : 3/13/2009

SMJH is to blame for this! They saw that Ricky had been in a conflict before with this Daniel kid. WHY didn't they separate the two before why did they have to wait until it was made into a bigger deal.They court should send ricky back to NORWALK to avoid being pressured into other problems SMJH should be the ones being held accountable to answer these charges not Ricky! All you idiotic people out there don't know anything. I bet you guys didn't spend one day in his court proceedings during his length trial or prelim. You guys don't know jack. Ricky is a nice boy. He was at the wrong place at the wrong time! All you fools are so PREJUDICED! Damn you guys are sad, believing anything the media says. Lets not forget they have the right to write what they want! Uh, jails can't separate everyone who might have a conflict. Inmates would all have studio apartments sprinkled throughout the land. Uh, newspapers are usually pretty accurate. Uh, the schools responsibility needs to end somewhere. Uh, the kid did kill someone.

Poor kid stuck in jail for murder. Its not his fault. Wrong place at the wrong time and he didn't mean to bring a knife. And he certainly didn't mean to stick it in that other kid. It's not his fault. Now he's in jail and the system is out to get him. What can we do to help this boy???

Is SB that bad?? : 3/16/2009

In reading the responses here, I'm trying not to convince myself that things in the SB area are really not that bad when it comes to gangs, Mexicans, fear and racism. One would think it is based on what is posted here. It looks as if this problem is not being addressed by the community as a whole. You have a group of municipal, non-profit and education leaders working on a strategy, but I wonder if they have held consecutive public forums throughout SB/Goleta to inform the public and to get public input. If the process for developing a comrehensive plan does not use a bottom up approach, I'm afraid that the public as a whole will not benefit from the process. Weeding out a problem requires simulatanous seeding of not just programs and services, but the promotion and marketing of everything that is being done to improve the situation. The joint gang sweep last year was a great law enforcement effort, but did it come with community policing activities for the residents who obey the law? We know live a society where people have to held accountable for services and if law enforcement is going to work to reduce crime in the area, residents have to organize to ensure that crime activity is reported. Santa Barbara should not insulate itself from its problems. Obviously based on what people are writing here demonstrates that there is a greater problem festering. Leaders need to do more outreach and create a sense of community. The annual Fiesta celebration has become a facade and no longer represents a reflection of the communities values. It sounds like SB needs to get back to the basics before it starts celebrating anything. It's unfortunate that SB has turned into a divided city. Maybe it will fall in the ocean as predicted, Don't forget that St. Barbara is the patron saint of sudden death.

read the comment right above yours. that should tell you enough. too many people like that running around town. too many "immigrants" working multiple jobs, and don't have the time to watch their kids. add that, the cultural "policy" of not informing law enforcement when crimes happen, and that is a recipe for gang trouble. there is nothing racial about this whatsoever. sure, you might have a few white, asian and black kids mixed in with the gangs, but there should be no surprise that over 85% of the gang members in SB are hispanic. the Chief and Mayor pretend to care, but when the chief is a suspected illegal alien himself, you think he is going to go out on a limb to protect the community? he acts more and more like Mayor Villar in LA every day. scary thought for us SB residents. Good Bye Santa Barbara : 3/16/2009

I'm the one who wrote about living in Old Town Goleta with a 5 year old child, and the intense racism and violence we experience here as we are not hispanic. Last night shortly after midnight my son wakes up and can't fall back asleep. I layed down in bed next to him and we talked. He was sleepy, and just randomly talking about various things. Then what popped out of his mouth was "I feel like the cholos that walk in front of our house are like guards". My son feels threatened by the gang members that stroll up and down our street. My son learned that the word "cholo" means gang member from our five year old neighbor. This neighbor's thirteen year old sister has been in and out of jail the past 1 & 1/2 years for gang crimes. The chronic anxiety that comes with living here is not worth it. It is time for us to leave the community. I hope the problems here in Santa Barbara and other hot spots like it don't spread to the rest of the country, because life is just not acceptable living like this.

it's not just kids growing up with parents who have multiple jobs, it's much more than that. Where they grow up has a significant influence on what they are doing. It's a bunch of factors making a bigger impact.

These kids are not going to change based on a rehab experience funded by you and I. That's a very nice idea and one that I support in cases where the kid has a solid support system and will actually stand a chance. Unfortunately, there are many more cases where the kid has NO support system or a very weak one. That is why they fall victim to gangs. They crave a sense of belonging and family so much that they turn to something sinister. Of course they didn't start out that way...and of course, it is a choice. But, there are so many bad people that prey on these types of kids. We're fighting a battle that we're not equipped to win with rehab, rainbows and well wishes. The best thing we can do is have a no tolerance policy and to work with parents to combat the gang situation in their home and in their neighborhoods. Maybe with those systems in place, rehab as you're proposing would be successful. Until then, it's not going to work for even 50%. Just a waste of money. Sad but true.

I fully agree with the last post. Seeing formerly nice, young kids go into gang life and seeing their parents not give a damn, no wonder we can't stop it. It starts at home, and until we address their home lives (which means the surrounding neighborhoods where they live, too) we can't solve it.
