Former tennis coach sentenced for sex crimes

By ERIC LINDBERG — Nov. 17, 2009

A former Santa Barbara High School assistant tennis coach was sentenced to one year in county jail after being found guilty earlier this year of having sex with a 16-year-old student.

Peter Aibor Jeschke was arrested in December 2007 and found guilty of sexual penetration by a foreign object, three counts of oral copulation and two counts of unlawful sexual intercourse, as well as a misdemeanor charge for possession of marijuana, by a jury in May of this year.

He was found not guilty of administering an intoxicating substance to a minor in order to commit a felony and furnishing marijuana to a minor. The jury was divided 7-5 on charges of furnishing cocaine and ecstasy to a minor.

“Given the defendant’s heinous actions towards a very vulnerable victim, he was deserving of a prison sentence,” Senior Deputy District Attorney Joyce Dudley said.

The prosecutor said she had pressed for a stiffer sentence of seven years and eight months in state prison for Jeschke, but the victim’s mother apparently asked that the defendant undergo rehabilitation.

Jeschke will return to court next month for final sentencing proceedings, during which Judge Frank Ochoa will decide whether the defendant must register as a sex offender. Following his one-year term in county jail, the defendant will be on probation with his state prison term suspended.

Dudley said if Jeschke violates his probation, he could be sentenced to the full prison term of seven years and eight months.

Jeschke also faces additional charges of witness intimidation after he allegedly asked several teenagers to call key witnesses and threaten them during his trial. He will appear in court next month as attorneys schedule a date for a preliminary hearing into those charges.

The defendant served as a volunteer for the boys tennis team at Santa Barbara High School in spring 2006 before being hired as an assistant coach for both tennis teams. The victim’s friends apparently learned of a sexual relationship between the 16-year-old student and the 34-year-old tennis coach, leading to his arrest.

Parenting is a verb : 11/17/2009

He should rot in jail with the girl's mother. Unbelievable.

A parent

gotta love sb- no crime that you cant rehab away
what a joke

One Year?! : 11/17/2009

He was found guilty of "sexual penetration by a foreign object, three counts of oral copulation and two counts of unlawful sexual intercourse, as well as a misdemeanor charge for possession of marijuana" and he's only getting one year?! And he "might" have to register as a sex offender?

Is this a joke?

1 year!!!!!!!!!!!!!!!!!!!! : 11/17/2009

What????
Why????

Slowjoe

Mother of Victim Nullification? wtf? : 11/17/2009

Are you effing serous????
The city probably spent millions trying to prosecute this dirt bag and the DA got the conviction! Case closed right? Nope, the Honorable Judge Ochoa rules to let this guy walk effectively sending a Warm Holiday Greeting to the child predators and rapists.
This is a disgusting perversion of the justice system, a letter -NOT EVEN FROM THE VICTIM HERSELF, BUT HER DEPRAVED MOTHER- makes such a compelling case for the judge that it convinces him to change his mind and not put him in prison. Is this full, fair, and impartial administration of justice?
I don't know who I am more disgusted with: The Mom, Judge Ochoa, or convicted Rapist Peter Jeschke. I say the judge and the rapist go to prison and the mom goes to the looney bin.
Excuse me while I go throw up.

All it takes is a letter.

I went to State Prison for three years and eight months for shoplifting a pack of ciggarettes and violating probation. The probation was for smoking a joint on Del Playa. While my sentence was deserved and I served it as positively as I could have, the fact remains that apparently a joint and a stolen pack of smokes is far more serious than what this moron did. My sentence was handed down in an election year. Funny how this guy was sentenced right AFTER an election.
Oh well, I hope he violates his probation cause theres some real nice folks waiting for him up at the ol' big house. 8)

somewhat amazed, but not surprised

Obviously Consensual : 11/18/2009

So you people are so freaked out because it involved drugs? Or what? I don't understand. 16, 34, not that big a deal. It's just sex.
Not saying he shouldn't be punished, but the guy doesn't sound like a predator.

Baers

Ochoa is a bigger joke than Paula & KEYT : 11/18/2009

This judge is a clown who has been overturned on some big decisions. SB deserves better. He usually saves this kind of leniency for his homies.

predator : 11/18/2009

the guy is a predator
my daughter was involved with the prosecution as the victim confided in my daughter - my daughter went to school & police officails and blew the whistle on this guy
the victim's mom fought my daughter and the truth my daughter was exposing -
mom needs help

: 11/18/2009

Mom obviously needs help because she's finding sympathy for the guy who abused her daughter. She should be standing by her daughter throughout this, and not the perpetrator. What must that do to the daughter? Oh yeah, gives her low self esteem so she gets involved with drugs and sexual predators.

She was 16, not 6!! : 11/20/2009

Did anyone here know that in a majority of US states what this guy did was legal? In fact there are only 18 other states that consider either 17 or 18 the legal ages of consent. In every other state 16 is good to go. If this had happened in Pennsylvania, with the exception of the drugs, there wouldn't an issue. But in California he's a monster right? He wasn't a kindergarten teacher, he was a high school girls tennis coach. I don't know this guy, but he's not a monster. The guy who kidnapped that poor girl 18 years ago and kept her all that time is a monster. This guy had consensual sex with a girl who was fully developed and was an active participant.

Give Me A Break

WTF??? : 11/20/2009

WHOA wait a minute---how does this slimeball get probation---multiple victims, position of trust, ongoing sexual activity, no remorse, intimidation of witnesses..............what am I missing here? HELLOOOO Miss D.A>, Mr. Judge-----i hate to think that his skin color and affluent upbringing in SB played a part---but give me a break! Imagine if the guy was black or Latino or the victims were male----hmmm let's see, probation? not so much, me thinks

Longtime justice system worker

Once Again....She was 16, not 6!!! : 11/20/2009

What he did was perfectly legal in a majority of US states!!! Look it up!!!

Give Me A Break

Look it up - : 11/20/2009

Well, we are not in the majority of states. I suggest you "look it up" - maybe you license plate would help. You're in CA!

Sick of predators

She was 16, not 6!!! : 11/20/2009

Really? Are we in California? You're an idiot! The point that I was making is that we arbitrarily set these ages. It makes no sense that it is wrong one place and completely legal in another. Get over it. She was part of it too. He didn't force himself on her. She was a willing and proactive participant.

Give Me A Break

Gimme a Break : 11/20/2009

Your are obviously not the parent of a 16 year daughter or son. I am, so please do us all the favor of staying away from our children. Consensual my a$$!!!! Having sex with someone under the influence is not consensual. I can't not believe you are even trying to justify this by throwing out other states laws. How about the 17 year old who had sex with another 17 year while she appeared intoxicated but never said no: he got 10 years in state prison. Something amiss in our courts.

mom

Give me a break! : 11/20/2009

Apparently Give Me A Break is or is potentially a pedophile because he thinks it is perfectly natural that a 34 year old man in a position of authority over a young, inexperienced, 16 year old girl would engage in a sexual relationship with her. If her Mother is just a nut case, maybe she was just looking for a Father figure and he totally took advantage of her trust. A year in jail is just a slap on the wrist. Maybe it will make him think he can do worse and get away from it. Judge Ochoa how would you feel if this were your daughter?

Furious Mother

The victim was 16 years old! : 11/20/2009

What the hell does that suppose to mean? It's illegal dumbass! Until we change the law, it's illegal and grown-up men and women should know that and stay away. How does this POS deserve 1 year in county jail? He took advantage and then makes things worse by committing witness intimidation. I would give him 15 years in prison, make him register as a sexual offender per 290 PC Megan's law. As for the Honorable Judge Ochoa, he's not the type of jurist I would like on the bench unless I was facing the music.

Butt Head

Ochoa is the problem : 11/20/2009

Judge Ochoa needs to go. He is the Judge that let the City Lot 10 murderer go, he let Hulsey go when she killed a man with her car, and no Ochoa lets Jeschke go. How many other criminals has Ochoa let go? The person who needs to go is Ochoa - he is letting criminals back on the street to kill and hurt again!!!

16, not 6!!!! : 11/20/2009

How in the world would you give him 15 years for something that is perfectly legal in other parts of our country?!!!!

Me in SB

Proud to be a Don ! You should not be proud of anything!!!! : 11/22/2009

So you are fine today in supporting 34 year old Peter Jeschke, who was convicted of raping a 16 year old girl, while coaching at SBHS in the trial by jury! If you are a parent, I pray none of your children or grandchildren are raped. If you are a boy or girl, I hope you have never been raped or never are. It is sad any Don would support a rapist. Peter Jeschke is a convicted rapist and will always be a convicted rapist. I feel bad for the shame he has brought his family and the Dons, always a rapist is he!

The Judge heard everything, did you? : 11/22/2009

Okay, the amount of blogger's that post their opinions and their feelings on here about this case, compared to the amount of people who took the time to listen to every single second of testimony from both the prosecution and defense, is likely to be in my mind close to 100 to 1. I'm not writing this to cast judgment upon any of the bloggers that are upset about the outcome of the sentencing, or try to convince people how great a guy Peter is. There was only one person who had all the information from both sides and listened to all the testimony regarding this case. That was the judge, Judge Ochoa. I'm pretty sure this wasn't his first trial in a case like this. I'm sure he took everything into consideration when deciding what the best sentence for Peter should be. I was there during the sentencing and heard everything that was said from the D.A. Joyce Dudley, the defense attorney, and from Judge Ochoa. There wasn't any information provided by the D.A. proving that Peter was a sexual predator, pedophile, or sexual deviant. You know there psychological tests that can be administered to determine if people show any behavioral tendencies for the above titles many blogger's are labeling Peter. So, if Peter would have taken one of these psychological evaluations and shown anything remotely close to any of these things, you all would have a right to be mad and also have the right to call him these things. So, for all those who don't get all the information prior to writing on these sites, Peter was administered one of these over 700 question tests by a reputable psychologist, and the result of the test was that he scored a 1. If you don't know what scoring a 1 means, here's more homework for you to do. On the other hand, the mother has every right to express her feeling of what the sentencing should be, seeing this has affected her family, no one else. I think the mother exhibit's amazing strength in herself and faith in family to grow stronger from all this and that she is not going to allow herself to be manipulated by the exaggerating and sometimes completely wrong statements made by not only you all, but by the media as well. She is an extraordinarily courageous woman, as well as Judge Ochoa, an extraordinary man for sifting through all the information, whether factual or made up, and making a decision that was best for what was actually proven and not just was said. Remember all you dedicated bloggers, hearsay is what you heard happened, not what you saw happened. If any of you have ever spent a year in jail, I suggest your try it before you go on saying that the sentence is a joke. The only thing I find funny is that all you bloggers that find the time to verbally assassinate Peter, Judge Ochoa, and the mother, don't have the spine to leave their actual first and last names. Oh, by the way, slander is a crime to you know!

Former Santa Barbara Tennis coach age???? : 11/23/2009

He Should learn Control and his eyes on the ball!!!!
=> Intimidation; Threats; and Access to our vulnerable young adults in training.
=> Registration as a sex offender and rehabilitation should be a default to the full prison term sentence.
=> Why & how can we pervent him from doing these heinous crime(s) ever again!

Tennis Mom/ athletic trainer

Jeschke #2 comming to a theater near you! : 11/24/2009

Dear Mark Jessup-Ellis: The jury, who heard the evidence, convicted Jeschke of several sex and alcohol/drug crimes. They didn't evaluate the case to deem Jeschke a predator, or not - the punishment that the Probation recommended had nothing to do with being a predator rather it took into account that he was convicted for the sex crimes. The injustice here was that Ochoa refused to listen to Probation, and the jury, and gave Jeschke practically nothing. But guess what, Mr. Ellis (obviously a biased Jeschke supporter) there will be Jeschke #2 - WITH A DIFFERENT JUDGE - where he will now be tried for victim / witness intidmiation and delivering drugs to, yes, you guessed it, more minors! The law is not over with Jeschke and he may yet find himself on the receiving end of Bubba in the big house.

Professional Abuse is real : 12/5/2009

I think what some people forget is he is an a position of authority. That should make him realize that he owes it to the student to hold himself up to a higher moral standard of conduct. Including not having sex with his students, or breaking the law by providing drugs or alcohol to them. In a professional role, the lines are usually quite clear. And in that role there can be an imbalance of power if it is crossed. He very clearly violated that role, and committed professional abuse.
I had been in a somewhat similar situation years ago. The coach used alcohol as a means to cross sexual boundaries with athletes. I think he did so in quite a manipulative fashion where he didn't try to fairly get the student's consent. He used really scare me. He harassed students; from verbal sexual harassment, to isolating students, and stalking. He seemed like a predator to me. He was not caught. He went on the lam, committed grand larceny, and somehow has still managed to elude jail time.
I think in terms of a professional environment, the lines should be drawn a little thicker, and that's what needs to be applied here. ie I don't think disagreeing with current sex laws make you a sex offender. There are some serious problems with the way they are applied.
I've heard of cruel things said and done in serious rape cases, and what I have noticed is some people seem more compassionate at times towards "underage sex" and than towards victims of serious sex offenses. We're willing to call someone a pedophile if they disagree with an age law, but yet to this day, there are rape cases, where people get physically hurt, and terribly psychologically damaged, and the system will blame the victim harshly, and let her perps walk without a day in jail. That's schizophrenic.

just me

Been there : 1/25/2010

Peter is a lazy slimebag who finally got caught at what he has ben doing for YEARS. He had a NCAA suspension in college for *shock* drugs, His favorites were ALWAYS marijuana and "X", He didn't grow up wealthy, but everything he did get he took for granted. He loves the ladies -- age was never a limit. Yeah Mark Ellis, I know him too. I'm sure we'll be hearing more from Pete in the future. And it's not libel if it's true.
