Two suspected gang members arrested for vandalism

By ERIC LINDBERG — Dec. 31, 2009

Santa Barbara police arrested two suspected Eastside gang members early Tuesday morning after an officer stumbled across one of the suspects spray painting gang graffiti on a Westside business.

After apprehending the suspects, officers found gang-related graffiti on the walls of businesses in a shopping plaza in the 1500 block of San Andres St., authorities said.

“The graffiti included gang symbols and references to local gang activity,” Lt. Ralph Molina said in a report. “The vandalism was similar to a recent rash of rival gang graffiti that has been occurring on the Westside of town.”

At approximately 1:10 a.m., Officer Doug Klug was on his regular beat patrol along San Andres Street when he saw a man later identified as Augustine Cruz, 19, allegedly tagging the walls of Super 99 Cents Plus.

The officer approached quietly and spotted another man walking toward Cruz. The unidentified subject saw the officer’s patrol car and alerted Cruz, and both men fled north through the plaza onto Cook Avenue.

After alerting dispatchers, the officer headed onto Cook Avenue and noticed a lone subject sitting in a parked vehicle.

“Believing this subject may also be involved, Officer Klug broadcasted the location of the parked vehicle and drove around the block looking for the subjects who ran,” Molina said.

The officer then returned to Cook Avenue and spotted the parked car leaving with a second subject in the passenger seat. He shined his spotlight on the vehicle and recognized the passenger as Cruz, police officials said.

With the help of another officer that arrived on scene, Klug stopped the vehicle nearby. Inside, officers found Cruz and the driver, identified as Reyes Cardenas, 26.

“Both subjects are known gang members and Cruz was found to have spray paint on his gloves,” Molina said.

The third subject, an apparent “lookout,” was not found. Officers searched the area and discovered additional gang-related graffiti on the walls of the Westside Market.

“The graffiti not only bolstered the Eastside street gang but challenged the Westside street gang, and the activity occurred deep on Santa Barbara’s Westside, where it was sure to be interpreted as a challenge by Westside gang members,” according to a police report.

Authorities booked Cardenas and Cruz for felony vandalism and participation in a criminal street gang. Officers allegedly turned up a single Vicodin pill while searching Cardenas and subsequently booked him for possession of a controlled substance. Bail was set at $30,000 for both suspects.

Dear School Board,
Please give our children and education that is meaningful to them, including recognition of their culture, so they will find ways to express themselves which earn them money.

I think that PARENTS should be teaching their own kids about their culture, it isn't up to the schools! Our schools and educators are meant to teach us to read and write. Your home is where you learn to be a civilized human being and not a drain on society.

SB native (of Mexican descent before you even start)

I agree SB native : 12/31/2009

just like i posted yesterday.... WHO IS RESPONSIBLE FOR THESE YOUNG ADULTS..... WHERE IS THE RESPONSIBILITY... AND RESPECT? WHITE, BLACK, MEXICAN, AMERICAN, JAPANESE OR YELLOW.... TEACH YOU \R KIDS NOT TO GO AND GRAFFITI OR CARRY BATS, METAL PIPES OR TAKE VICODIN.... ..... DONT LET THE STREETS EAT UP YOUR KIDS.... BUCK UP AND ACT ON IT NOW BEFORE THEY END UP IN PRISON AND YOU LOOSE THEM FOREVER

A REAL LOCAL

Sentencing : 12/31/2009

I second those who say 'no leniency!' This is vandalism, costs real time and money, and hurts us all. Make them clean up graffiti for free for MONTHS. Enough!

Teach responsibility & consequences

Kids(?) : 12/31/2009

That looser in the car was 26 years old...! How about we build a Cage fighting arena somewhere between the ES & WS... See if these punks can handle a one on one beating.

What a joke : 12/31/2009

These people have nothing in their lives of any value (family, job, goals) so they create something they can care about... their location (east or west). They're willing to commit multiple felonies because they believe that the risks of incarceration somehow show an allegiance to their "cause." What's worse is they will have kids - sometimes as a means of getting out of the gang - and they will teach their kids these same distorted beliefs or worse, their kids will learn the same things on the streets because their parents are locked up.
I'd have to agree with some of the other posts. The parents have failed these kids, now it's up to the school systems and the community to teach them to seek accomplishment and reach goals, otherwise they're going to continue on this road to jail.

Let me guess... The parents snuck across the border years ago and are hard working laborers. Unfortunately, their loser kids were born here. They don't want to work their fingers to the bone like their parents and their mexican culture does not encourage doing well in scool so they become gang bangers and leach offl society around them down to survive. Their kids will also be gang bangers.

: 12/31/2009

What a joke:
There's a lot of truth to what you say. Unfortunately even bad family traits continue genderation to generation. How to break that cycle is a huge problem when the parents see nothing wrong with their attitudes. But when "kids" go astray because hardworking parents are working all the time to make ends meet is sad.
The community and schools can reach some of these kids, but mentoring programs need funding and that's another story.
The 26 year old hanging out destroying public property obviously doesn't know where his taxes go...if he had a job. Chances are that $3,000 with a bondsman--they'll be out for the weekend.

just me

just me : 12/31/2009

Yeah, that's another good point; Some of the parents are working their butts off to try and provide a better life for their kids, but that means they're never home to actually raise their kids. But if these negative traits are passed generation to generation, then that's another example of the parents failing - actively failing. It's time for someone else to step in, otherwise we're all caught in their cycle of crime.

If they are a proven gangbanger, send them to the army. That program will straighten their little asses out. Straight to Afganistan.

Taggers = Losers : 1/1/2010

I say give them a thorough beating. The criminal justice system doesn't work and won't deter this behavior afterward. Can I be the one to administer it?

Throw the book at us... : 1/2/2010

Ive said it a million times, for those who grew up in SB, when I was younger, we had a lot of things to do. Our kids need more positive things to do... A skate park doesn't cut it... A bowling ally doesn't cut it...

Have you seen a gang member or just a young punk take advantage of any organized activity or program in Santa Barbara? Nooooooo. Offering more things to do is not the answer. There are tons of things to get involved in in Santa Barbara. Anyone who doesn't think so isn't looking. We're one of the best places in the state for things to do.

Augie : 1/4/2010

Damn homie talk about wrong place wrong time. Keep yo head up

two suspected gang members : 1/5/2010

I have just one question for you. Why do you print. Names of suspects. Do you not know that this can cause further retaliation to the victim or victims families. Using names of gang member can cause a death. I ask is it important that we know the names of these gentlemen. I personally know that one of these men, Retreat Cardenas,is not a gang member. He is an honest worker, who goes to work every morning and pays rent and bills like everyone else. Molina of the Police Department knows this to be true. If he denies it then he needs to start getting honest and I say shame on him.
Perhaps some people think if gang members continue to kill each other we can get them off the streets permanently.

: 1/5/2010

Well, yeah, if they kill each other they are off the streets permanently.

Enough : 1/10/2010

What ever happened to Innocent until proven guilty! The driver was not caught in the act of vandalism, and how do we even know that he is a gang member? This gentleman has now been labeled. Do we actually know he knew what was going on. Maybe he was called for a ride. Let the court system seek justice in this case.

Enough? : 1/12/2010

Whatever! He will get his day in court to "vindicate" himself. Until then, the dirt bag is in the court of public opinion. When his judicial "vindication" is declined then the court of public opinion will have been vindicated. That's how it works in this persons case.

Enough? : 1/12/2010

And by the way, I would hardly describe this dirt bag accomplice as a "gentleman".

my opinion : 1/25/2010

People who name call suffer from low self esteem, and self worth. Your entitled to your own opinion as everyone else, but when one starts to call names to others you loose the respect of others. We as adults should be role models to all youth and treat each other with respect

QUESTION? : 1/26/2010

What kind of haircut DID the driver have?
Well ..If it quacks like a Duck ,walks like Duck, and looks like a Duck---GUESS WHAT!!!!!
Please make the punishment MATCH the Crime' You know 'if they spray painted on walls on the other gangs'' TURF''
Just make them paint over their TAGS to show RESPECT [In front of EVERY BODY AND THEIR MOMMY]
Then lets see how many businesses and walls get vandalized?!!

YOU KNOW ME!!

To: my opinion : 1/29/2010

What are you, some kind of wanna be psychologist? Your opinion is absolutely stupid. (Please know I am laughing at you and really not at all upset with you). My calling these people "dirt bags" is not because of low self esteem. It is because I am sick of these DIRT BAGS! vandalizing my local properties. I constantly have to clean up these scum bags' mess. It's like a bunch of dogs pissing on fire hydrants and car tires. Why don't you post your address and I will come by and spray paint your property. Then, when you start to cuss me out and call me names, I will gladly point out to you that you're merely suffering from low self esteem. You are ridiculous! Indignant frustration is not low self-esteem rather your self-righteous, holier than thou attitude is much more indicative of your accusations.

: 1/30/2010

Lol @myopinion low self-esteem. Its the Parents, Community, and School System that failed these kids, and graffiti been around for Thousands of years, "expressed arts" for good or bad...but to help supress the problem of graffiti ones' punishment should be, public cleaning and community service. A little embarrassment goes along way. "Have u every pissed yourself in Elementary, i bet that rarely ever happened again later in life. ;:-)
Make the punishment Fit the crime!

Pewetang

: 1/30/2010

Graffiti is not about art, it's about claiming territory, like a dog pissing on a tree.

Graffiti : 2/13/2010

I beleive that most of these "Gangbangers" parents do not even lnow what their kids are up to since the only language spoken in the home is spanish and they have no understanding of how the US Laws work,. In order to stop this nonsense, 1: File a gang injunction on these punks 2: Don't worry about the tourisim in SB, blast their faces and names all over every public place possible 3: Most importantly over 1 and 2: DEPORT THESE PUNKS AND THEIR FAMILES BACK TO MEXICO AND LET THEIR OWN COUNTRY DEAL WITH THEM.. GUARANTEED WITH THE DRUG CARTEL IN MEXICO THESE PUNKS WOULDN'T STAND A CHANCE THEY WOULD BE COWARDS.......
